Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

Given the food challenges that society is facing, we draw upon recent developments in the study of how food reputation affects food preferences and food choices, providing here a starting standard point for measuring every aspect of food reputation in different cultural contexts across the world. Specifically, while previous attempts focused either on specific aspects of food or on measures of food features validated in one language only, the present research validates the Food Reputation Map (FRM) in Italian, English and (...) Chinese over 2250 participants worldwide. Here we successfully measure food reputation across twenty-three specific indicators, further grouped into six synthetic indicators of food reputation. Critically, results show that: a) the specific measurement tool of food reputation can vary across cultural contexts, and that b) people’s reputation of food products or categories changes significantly across different cultural contexts. Therefore, in order to understand people’s food preferences and consumption, it is important to take into account the repertoire of cultural differences that underlies the contexts of analysis: the three context-specific versions of the FRM presented here effectively deal with this issue and provide reliable context-specific insights on stakeholders’ interests, perspectives, attitudes and behaviors related to food perceptions, assessment and consumption, which can be effectively leveraged to foster food sustainability. Like the cracking of the genetic code and the creation of the atomic bomb, the discovery of how the brain's neurons work is one of the fundamental scientific developments of the twentieth century. The discovery of neurotransmitters revolutionized the way we think about the brain and what it means to be human yet few people know how they were discovered, the scientists involved, or the fierce controversy about whether they even existed. The War of the Soups and the Sparks tells (...) the saga of the dispute between the pharmacologists, who had uncovered the first evidence that nerves communicate by releasing chemicals, and the neurophysiologists, experts on the nervous system, who dismissed the evidence and remained committed to electrical explanations. The protagonists of this story are Otto Loewi and Henry Dale, who received Nobel Prizes for their work, and Walter Cannon, who would have shared the prize with them if he had not been persuaded to adopt a controversial theory (how that happened is an important part of this history). Valenstein sets his story of scientific discovery against the backdrop of two world wars and examines the fascinating lives of several scientists whose work was affected by the social and political events of their time. He recounts such stories as Loewi's arrest by Nazi storm troopers and Dale's efforts at helping key scientists escape Germany. The War of the Soups and the Sparks reveals how science and scientists work. Valenstein describes the observations and experiments that led to the discovery of neurotransmitters and sheds light on what determines whether a novel concept will gain acceptance among the scientific community. His work also explains the immense importance of Loewi, Dale, and Cannon's achievements in our understanding of the human brain and the way mental illnesses are conceptualized and treated. (shrink)

Background In neonatal intensive care, a child's death is often preceded by a medical decision. Nurses, social workers and pastors, however, are often excluded from ethical case deliberation. If multiprofessional ethical case deliberations do take place, participants may not always know how to perform to the fullest. Setting A level-IIID neonatal intensive care unit of a paediatric teaching hospital in the Netherlands. Methods Structured multiprofessional medical ethical decision-making (MEDM) was implemented to help overcome problems experienced. Important features were: all professionals (...) who are directly involved with the patient contribute to MEDM; a five-step procedure is used: exploration, agreement on the ethical dilemma/investigation of solutions, analysis of solutions, decision-making, planning actions; meetings are chaired by an impartial ethicist. A 15-item questionnaire to survey staff perceptions on this intervention just before and 8 months after implementation was developed. Results Before and after response rates were 91/105 (87%) and 85/113 (75%). Factor analysis on the questionnaire suggested a four-factor structure: participants' role; structure of MEDM; content of ethical deliberation; and documentation of decisions/conclusions. Effect sizes were 1.67 (p<0.001), 0.69 (p<0.001) and 0.40 (p<0.01) for the first three factors respectively, but only 0.07 (p=0.65) for the fourth factor. Nurses' perceptions of improvement did not significantly exceed those of physicians. Conclusion Professionals involved in ethical case deliberation perceived that the process of decision-making had improved; they were more positive about the structure of meetings, their own role and, to some extent, the content of ethical deliberation. School psychologists often break confidentiality if confronted with risky adolescent behavior. Members of the National Association of School Psychologists ( N = 78) responded to a survey containing a vignette describing an adolescent engaging in risky behaviors and rated the degree to which it is ethical to break confidentiality for behaviors of varying frequency, intensity, and duration. Respondents generally found it ethical to break confidentiality when risky adolescent behaviors became more dangerous or potentially harmful, although there was considerable variability between (...) respondents. Significant gender effects were found between male and female respondents for alcohol use, and a significant Form Type (i.e., male or female vignette) Frequency/Duration interaction was observed for antisocial behaviors. School psychologists could benefit from further training in ethical decision making because these ethical dilemmas are not always clear-cut. (shrink)

Recent evidence suggests that if a deterministic description of the events leading up to a morally questionable action is couched in mechanistic, reductionistic, concrete and/or emotionally salient terms, people are more inclined toward compatibilism than when those descriptions use non-mechanistic, non-reductionistic, abstract and/or emotionally neutral terms. To explain these results, it has been suggested that descriptions of the first kind are processed by a concrete cognitive system, while those of the second kind are processed by an abstract cognitive system. The (...) current paper reports the results of three studies exploring whether or not considerations about possible future consequences of holding an agent responsible at a present time affect people’s judgments of responsibility. The results obtained suggest first that the concrete system does not produce compatibilist judgments of responsibility unconditionally, even when facing appropriately mechanistic, reductionistic, emotionally loaded and concretely worded deterministic scenarios. Second, these results suggest that considerations about possible future consequences for innocent third parties that may follow as a result of holding an agent responsible affect people’s judgment as to whether or not the agent is responsible for what she did. Finally, it is proposed that these results compliment extant evidence on the so-called “Side-effect effect”, as they suggest that emotional reactions toward possible future side effects influence people’s judgment of responsibility. The impact of these results for philosophy and moral psychology is discussed. (shrink)

Vladimir Solov'ev (1853-1900- is regarded as the most original and systematic of the Russian philosophers in the 19th century. He has once again become the subject of international scholarly attention both in Slavic countries and the West. This volume contains selected papers presented at the international conference on Vladimir Solov'ev held at Nijmegen University, the Netherlands, in September 1998. The scope of this conference was wide-ranging, dealing with theological, metaphysical, philosophical and historical themes. Though Solov'ev's broad intellectual activity defies any (...) strict attempt at categorisation, the editors have classified its major themes under the dual characteristic of reconciliation and polemics. Solov'ev was passionately committed to the reconciliation of all beings under the idea of all-unity, which he attemted to achieve by engaging in uncompromising polemics with his contemporaries, The thirty contributors to this volume are specialists from Russia, Ukraine, Bulgaria, Western Europe and the United States. The volume makes a significant contribution to the intellectual reassesment of Vladimir Solov'ev since the rediscovery of his philosophical heritage in his own homeland in the 1980s. (shrink)

The nm23 gene, a putative metastasis suppressor gene, was originally identified by its reduced expression in highly metastatic K‐1735 murine melanoma cell lines, as compared to related, low metastatic melanoma cell lines. Transfection of nm23 cDNA has been reported to suppress malignant progression in Drosophila and mammalian cells. Highly conserved homologues of nm23 have been found in organisms ranging from the prokaryote Myxococcus xanthus to Drosophila, where the gene is involved in normal development and differentiation. The product of the nm23 (...) gene exhibits a nucleoside diphosphate kinase activity, yet the nucleoside diphosphate kinase activity of Nm23 does not correlate with its apparent biological functions. We review recent cellular, genetic, biochemical and X‐ray crystallographic data to formulate and evaluate hypotheses concerning the molecular mechanism of nm23 action. (shrink)

Some jurisdictions that have decriminalized assisted dying exclude psychiatric patients on the grounds that their condition cannot be determined to be irremediable, that they are vulnerable and in need of protection, or that they cannot be determined to be competent. We review each of these claims and find that none have been sufficiently well-supported to justify the differential treatment psychiatric patients experience with respect to assisted dying. We find bans on psychiatric patients’ access to this service amount to arbitrary discrimination. (...) Proponents of banning the practice ignore or overlook alternatives to their proposal, like an assisted dying regime with additional safeguards. Some authors have further criticized assisted dying for psychiatric patients by highlighting allegedly problematic practices in those countries which allow it. We address recent evidence from the Netherlands, showing that these problems are either misrepresented or have straightforward solutions. Even if one finds such evidence troubling despite our analysis, other jurisdictions need not adopt every feature of the Dutch system. (shrink)

These essays explore the continuities and discontinuities between the Neo-Confucian thought of Ming China and early Tokugawa Japan and the "practical learning" of the 17th and 18th centuries, underlining the need for a deeper examination of the complex relationship between "traditional" and "modern" thoughts and values.

I offer a new cartography of ethical resistance. I argue that there is an uncharted interaction between managerial secrecy and organizational silence, which may exponentially increase the incidence of corruption in ways not yet understood. Current methods used to raise levels of moral conduct in business and government practice appear blind to this powerful duo. Extensive literature reviews of secrecy and silence scholarships form the background for an early stage conceptual layout of the co-production of secrecy and silence.

O presente artigo analisa o crescimento das instituições escolares salesianas no Antigo Sul de Mato Grosso no final do século XIX e início do XX e o ideal de um processo civilizador educacional, empreendido pela Igreja Católica, protagonizado pela congregação salesiana a qual atuou para assegurar prerrogativa educacionais ao passo que o Estado brasileiro laicizava-se. Henricus Regius ou Henri LeRoy, outrora amigo e divulgador da filosofia de Descartes, agora escrevendo como adversário de seu antigo mestre, publica em Utrecht um panfleto anônimo sobre a natureza da mente humana. No intuito de evitar que as teses apresentadas por seu ex-discípulo fossem tomadas como suas, Descartes decide, então, refutar as opiniões defendidas no panfleto de Regius. É precisamente o texto produzido por Descartes nessa ocasião que é traduzido a seguir. Esse texto, aparentemente impresso sem o consentimento de (...) seu autor em dezembro de 1647, marca o ponto final da relação entre o filósofo francês e o professor de medicina. As chamadas políticas de identidade estão hoje enfatizadas entre os debates educacionais em esfera global-local, reiterando, na luta discursiva, significantes como currículo, cultura, alteridade e diferença. A aposta em termos como diálogo e tolerância não tem sido casual. No Brasil, as demandas da diferença vêm sendo objeto de múltiplas articulações políticas, sobretudo, desde os anos pós-ditadura militar em meio a estratégias e tensões que ressignificam, segundo o contexto, acordos e dissensos. Em jogos de poder, questões circunscritas pela ênfase em raça/ (...) etnia, gênero e sexualidade, principalmente, tem ocupado espaços de discussões. O objetivo deste trabalho, nesse contexto, indubitavelmente conflituoso, é argumentar em defesa da compreensão dos processos híbridos de subjetivação, ampliando espaços para a diferença e para a ambivalência, em vez do enfoque na luta entre opostos com base em sujeitos pré-dados. Assim, distanciando-me da dialética hegeliana, procurei tecer no presente texto um diálogo com o pesquisador indo-britânico Homi Bhabha, bem como algumas das suas bases epistemológicas e filosóficas, cujo escopo teórico e político tem sido reler e ressignificar os debates da diversidade e do multiculturalismo sob a ótica pós-colonial dos fluxos e do hibridismo. Nesse sentido, currículo está longe de ser pensado por limites eficientistas e instrumentais, tal como documento, como grade curricular, como base estrutural. Em uma abordagem não realista, currículo é pensado como uma política cultural, constitutivo pela contingência, entendido como a própria luta pela enunciação do que vem a ser currículo, a qual se dá, inexoravelmente, no terceiro espaço ou nos interstícios, conforme propõe Bhabha. The practice of making datasets publicly available for use by the wider scientific community has become firmly integrated in genomic science. One significant gap in literature around data sharing concerns how it impacts on scientists’ ability to preserve values and ethical standards that form an essential component of scientific collaborations. We conducted a qualitative sociological study examining the potential for harm to ethnic groups, and implications of such ethical concerns for data sharing. O objetivo do presente texto é trançar experiências com o magistério indígena, dialogando com nossas memórias e referenciais. O texto sai então do trivial, abrindo espaço-tempo para outro modo de escrita coletiva. O inacabamento caracteriza nossa opção, ressaltando mais a riqueza do processo intercruzado, tecido a partir de nossos encontros e conversas, a princípio, aleatórios e depois mais estruturados para a condução deste texto. No ano de 2019, tivemos a fecunda e singular oportunidade de, a partir de distintas áreas de (...) conhecimento e ênfases teórico-metodológicas, atuar como professores de estudantes indígenas, guarani e pataxó, de maneira a contribuir com um curso de qualificação, intermediado por um projeto, vinculado ao Estado do Rio de Janeiro. A rememoração do curso através dos nossos diálogos e escrita exibe a insistência daquela experiência em e entre nós, sinalizando sentidos e se fazendo como acontecimento propício a sentir/pensar processos de alteridade-mesmidade. O presente artigo discute possibilidades de articulação da dimensão multicultural na perspectiva do professor e da juventude, analisando implicações para o ensino na escola. Utilizei como fonte o Banco de Teses do site da Capes. O objetivo foi pensar como a epistemologia multicultural pode contribuir à identidade juvenil de maneira positiva. O eixo principal da interrogação está na dualidade diferença/ igualdade na luta contra preconceitos e estereótipos. A pesquisa indica limites e potenciais nas mudanças curriculares numa perspectiva multicultural crítica. Contudo, (...) a prática monocultural é um problema educacional e social que tem raízes históricas. Concluo que é possível pensar um ângulo multicultural na educação com a juventude. Nesse ponto de vista, uma pista pode ser o papel da pesquisa multicultural na formação do professor e no currículo. (shrink)

The aim of this paper is to show to what extent Descartes can be situated within the Augustinian metaphysical tradition and to what extent he has departed from it. To this end, we will argue that Descartes has borrowed his main Meditations’ arguments from Augustine’s philosophy. However, in spite of all factual and textual evidence we will provide against the originality of Descartes’ metaphysical discussions, it will be stressed, on the other hand, that in borrowing not only the cogito argument, (...) but also some general features of his philosophy from Augustine’s works, Descartes intends to frame a metaphysics which will be the ground on his new mechanistic physics. Having this in mind, we will hold that no claim can be put forward against the originality and far-reaching scope of Descartes’ philosophical intentions. Indeed, Descartes’ purpose is to build a new science under a metaphysics, even though this metaphysics is the Augustianian one. (shrink)

How should we make decisions when we do not know the relevant physical probabilities? In these ambiguous situations, we cannot use our knowledge to determine expected utilities or payoffs. The traditional Bayesian answer is that we should create a probability distribution using some mix of subjective intuition and objective constraints. Imprecise Bayesians argue that this approach is inadequate for modelling ambiguity. Instead, they represent doxastic states using credal sets. Generally, insofar as we are more uncertain about the physical probability of (...) an event, there is more divergence in the credal set. Hence, their approach can represent these ambiguities via the extent of the divergence. Imprecise Bayesianism has mostly been advocated for its epistemological features. In this article, we examine its properties for decision-making. We develop a model for comparing standard and Imprecise Bayesianism by testing their performances in a classic decision problem. We find that the representational tools of Imprecise Bayesianism also cause it to underperform in our tests. This issue has been overlooked, because previous research on Imprecise Bayesianism has not utilised agent-based modelling to provide information about its performance in the short-run. Overall, we reveal the Ambiguity Dilemma for Imprecise Bayesianism: To what extent should one value representational power or decision-making performance? (shrink)

ABSTRACT This article aims to analyze, from a Bakhtinian perspective, the grotesque construction of Mexican artist Frida Kahlo’s body through a religious worldview. Therefore, we analyze two of her self-portraits, taking into account the dialogic relations constructed between the grotesque representations and Catholic symbology. The analyzed utterances, in which the specificities of the creative competence of the author-creator in her aesthetic activity are inferred, showed that a dialogue is established between the painting El venado herido and Catholic Saint Sebastian and (...) between the painting Las dos fridas and the image of the Sacred Heart of Jesus.
